JUSTICE SUDHIR SINGH ORAL ORDER 27-09-2016 Heard learned counsels for the petitioner, informant and learned counsel for the State.
The petitioner is languishing in custody since 24.04.2016 in connection with Sidhwalia P.S. Case No. 30 of 2016 for the offences instituted under Sections 304(B)/34 of the IPC. The accusation is of killing the daughter of the informant due to non-fulfilment of dowry demand by the accused persons. It has been submitted on behalf of the petitioner that the petitioner is in custody since 24.04.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of the witnesses alleged against the petitioner. He has got no criminal antecedent. The petitioner is the Dewar of the deceased. He is separate in mess and property from the husband of
Patna High Court Cr.Misc. No.27860 of 2016 (4) dt.27-09-2016 2/2 the deceased. The witnesses in paragraph nos. 31 and 36 of the case diary have stated that the deceased got fire while she was cooking and subsequently in course of treatment, she succumbed to the burn injuries.
On behalf of the learned counsels for the informant and the State, it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. VIII, Gopalganj, in connection with Sidhwalia P.S. Case No. 30 of 2016.
