This is a petition for grant of regular bail for offences under Sections 363, 364, 364A, 302, 201, 115 and 120B of the Indian Penal Code.
Ritik Kumar, the son of the informant left the house. However, he did not return back. Thereafter, first information report of kidnapping was lodged against unknown. Subsequently, dead body of Ritik Kumar was recovered. The impugned order reveals that prayer for bail of the petitioner has been refused for the reason that name of the petitioner transpired in the confessional statement of the co-accused. There is no eye witness of the occurrence.
Considering the aforesaid fact, specially the fact that there is no substantial material against the petitioner, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-
Patna High Court Cr.Misc. No.8564 of 2017 (2) dt.01-03-2017 2/2 (rupees ten thousand) with two sureties of the like amount each in connection with Mejorganj P.S. Case No. 256 of 2015 to the satisfaction of the Additional Chief Judicial Magistrate, Sitamarhi, or successor Court.
