This is a case registered under Sections 302/120(B) of the Indian Penal Code and 27 Arms Act.
As per the FIR the marriage of the deceased was fixed with the instant petitioner and it is alleged that the marriage was fixed against her will so she has got the petitioner eliminated. It is submitted by the petitioner's counsel that coaccused mother of the instant petitioner has already been allowed bail in Cr. Misc. No. 40292 of 2017 and subsequent to lodging of the instant case the police have lodged a case in which one Moin Ansari @Munna Ansari is said to have given fatal firearm injury upon the deceased. Patna High Court Cr.Misc. No.18174 of 2018 (3) dt.04-05-2018 2/2 incriminate the petitioner with the alleged occurrence and on such allegation the petitioner having no criminal antecedent is in custody since 19.04.2017.
In the facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of 4th Additional District and Sessions Judge, Sasaram at Rohtas, in connection with S. Tr. No. 301 of 2017 arising out of Bikramganj P.S. Case No. 109 of 2017 subject to the conditions :
(i) That one of the bailors will be a close relative of the Petitioner who will give an affidavit giving genealogy as to how he is related with the Petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the Petitioner.
(ii) That the Petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
