JUSTICE VINOD KUMAR SINHA ORAL ORDER 14-08-2019 Petitioner seeks bail in anticipation of her arrest in connection with Ramgarhwa P.S. Case No. 48 of 2019 registered for the offences punishable under Sections 272, 273 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 10 litres of liquor from the house of the petitioner.

Submission of learned counsel for the petitioner is that petitioner is a lady and she has falsely been implicated and she has no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail stating that this application is not maintainable. In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court CR. MISC. No.36349 of 2019(3) dt.14-08-2019 2/2 petitioner. If petitioner surrenders and prays for regular bail, the same shall be considered on its own merit, without being prejudiced by this order and, if possible, to be disposed of on the same day.

With the above observation, this application is dismissed.
