JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 30-04-2015 Learned counsel for the petitioners submits that petitioner Nos. 1,5,6,7 and 8 have already been arrested and thisr application has already been dismissed as withdrawn to the extent it relates to petitioner nos.1,5,6,7 and 8 by orders dated 30.01.2015 and 13.02.2015.
13 petitioners are accused in a case registered for the offences punishable under Sections 147, 148, 149,323, 324,307, 379,452 & 504/34 of the Indian Penal Code and they have filed
Patna High Court Cr.Misc. No.48710 of 2014 (4) dt.30-04-2014 this application for anticipatory bail as they apprehend their arrest. Learned counsel for the petitioners has submitted, referring to the First Information Report, that the petitioners and the informant are co-villagers. He further submits that as per the First Information Report itself there is land dispute between the parties. A counter case has also been instituted by the side of these petitioners on the same date i.e 11.5.2014 being Sono (Charkapathar) P.S. Case No. 99 of 2014.
In view of the submission as above, let petitioners No. 2,3,4 and 9 to 13 in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM, Jamui in Sono (Charkapathar) P.S. Case No. 98 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
