The petitioners, namely, Ram Sagar Poddar, Amirka Devi @ America Devi and Sunita Devi @ Sumitra Devi, apprehend their arrest in Kusheshwar Asthan P.S. Case No. 114 of 2015 registered under Section 341, 323, 447, 379, 504, 509/34 of the Indian Penal Code and Sections 3 / 4 of The Prevention of Witchcraft Practices Act.
The informant alleged that the petitioners assaulted the informant and also took away ornaments from the possession of the daughter-in-law of the informant. It is submitted that there is a counter-version. On account of land dispute, the scuffle took place between the two sides but no visible injury was caused to
Patna High Court Cr.Misc. No.30013 of 2016 (2) dt.06-09-2016 2/2 either side.
Considering the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Biraul, Dist. Darbhanga in Kusheshwar Asthan P.S. Case No. 114/2015, corresponding to G.R. Case No. 301/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
