Petitioner is said to have given Farsa blow causing head injury to the injured of the present case. No doubt, petitioner carries criminal antecedent but submission on behalf of the petitioner is that almost all the cases were lodged against the petitioner on account of land dispute. It would appear from perusal of the record that earlier, the prayer for bail of the petitioner was rejected by this Court vide order dated 31.03.2016 passed in Cr. Misc. No. 12967 of 2016 in presence of learned counsel for the informant and at that time, an assurance was given on behalf of the informant to produce his witnesses before the trial court within a month but report of

No.30667 of 2016 (3) dt.21-09-2016 2/2 learned Judicial Magistrate 1st class West Champaran goes to show that the case of the petitioner was committed to the court of sessions recently, i.e, on 23.07.2016 and the case of the petitioner is still pending in the court of sessions.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Bagaha, West Champaran in connection with Bagaha P.S.case No. 328 of 2014.
