The petitioner seeks regular bail in connection with Dagarwa P.S. Case No. 203 of 2017, registered for the offence punishable under Sections 8/20 (b)(ii) (c)/25/29 of the N.D.P.S. Act.
The allegation in brief is that the petitioner was found sitting in a scorpio vehicle alleged to have been escorting a truck carrying huge quantity of ganja. The learned Senior Counsel for the petitioner submits that the petitioner's vehicle was moving ahead of the truck at that point of time and the police merely on suspicion has apprehended the petitioner, no incriminating article has been recovered from the scorpio vehicle, similar situated another co-accused also moving on the said scorpio vehicle namely
Patna High Court Cr.Misc. No.24366 of 2018(3) dt.04-07-2018 2/2 Subodh Kumar has been admitted to bail by this Court vide Cr. Misc. 15777 of 2018. It is further submitted by the learned Senior Counsel that the petitioner has a clean antecedent and he is in custody since 12.12.2017. The learned Senior Counsel has also produced an order dated 27.04.2018 passed in Criminal Miscellaneous No. 25907 of 2018 by which similarly situated co-accused person has been granted regular bail. Lastly, the learned Senior Counsel submits that some other co-accused persons have also been granted regular bail by Annexure-2 to the petition.
Having regard to the facts and circumstances of the case, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on regular bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Sessions Judge cum Special Judge, Purnea in connection with Dagarwa P.S. Case No. 203 of 2017.
