JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 The petitioner is apprehending her arrest in connection with Begusarai Muffasil P.S. Case No. 95 of 2014 for the offences instituted under Sections 304(B) and 201/34 of the I.P.C. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the marriage of Sushma Kumari was solemnized with Chandan Kumar on 14.02.2013 and at the time of marriage, ornaments were presented as gift. The husband and members of in-laws family further started demanding Pulsar Motorcycle and it was threatened that Chandan would perform marriage with another girl,. in case of nonfulfillment of demand. After getting information, the informant paid Rs. 10,000/- and Rs. 40,000/- and he also gave Rs. 75,000/-

Patna High Court Cr.Misc. No.24256 of 2015 (2) dt.13-07-2015 2/2 to the in-laws again on demand. The accused persons again started torturing the daughter of the informant. After some time when the informant went, he learnt that his daughter fled away, but this fact was false and Sushma was murdered by her husband, in-laws and brother-in-laws and all of them have disappeared her dead body also.

It has been submitted on behalf of the petitioner that the petitioner is the mother-in-law of the deceased. It is further submitted that the petitioner is separate in mess and property and has got no concern with the husband of the deceased. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of her arrest or surrender before the learned court below within a period of four weeks from today in connection with Begusarai Muffasil P.S. Case No. 95 of 2014 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Begusarai, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
