2. In the instant petition, petitioner has prayed for the following relief/reliefs:

"That this application is being filed for issuance of an appropriate writ/s, order/s or direction/s for setting aside the letter dt. 11th of September, 2019 issued by the Recruitment, Board (Respondent No. 2)

Patna High Court CWJC No.1837 of 2021 dt.20-04-2022 2/2 by which the petitioner has been rejected due to height bar and for a direction to the respondents to take an appropriate steps for selection of the petitioner for the constable (GD) in Central Armed Police Force (CAPFS), pending final hearing of this case, the respondents may be directed to keep one post reserve for the petitioner in the selection process."

3. On 24.01.2022, the concerned respondent was directed to re-examine the petitioner's height for the purpose of selection and appointment to the post of Constable (GD) in Central Armed Police Force. Petitioner was subjected to height measurement in terms of the order dated 24.01.2022 and he was found qualified.

4. Learned counsel for the respondents on instruction submitted that petitioner has not passed the Physical Efficiency Test in running event, therefore, the present petition do not survive for consideration. Reserving liberty to the petitioner to question the validity of further selection, if any, since fresh cause of action accrues.
