JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with Thakurganj PS case No. 113/2014 for the offence under section 302, 201, 120(B) of the Indian Penal Code. The prosecution story, in brief, is that there was a land by the side of the house of informant which was in the possession of his mother and the accused persons wanted to dispossess and on protest made by his mother they used to threat to kill her. It is alleged that on 24.01.2014 at about 8 PM all the accused persons by hatching conspiracy killed his mother by hanging. It has been submitted on behalf of the petitioner that prior to institution of the present case an U. D. case was instituted and the same was found to be true but the informant with an

Patna High Court Cr.Misc. No.24303 of 2015 (2) dt.13-07-2015 2/2 intention to falsely implicate the petitioner filed false complaint case which was later on forwarded for institution of first information report under section 156(3) of Cr. P.C. It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kishanganj in connection with Thakurganj PS case No. 113/2014, subject to condition as laid down under section 438(2) of the Cr. P.C.
