JUSTICE SUDHIR SINGH ORAL ORDER 13-07-2015 Heard learned counsel for the petitioner and the State. The petitioner is apprehending his arrest in connection with complaint case No. 1173 (C)/2013 for the offence under section 498A of the Indian Penal Code.

The prosecution story, in brief, is that the complainant was married to petitioner on 25.11.2003. Unfortunately, she filed maintenance case in which interim order for maintenance was passed but the petitioner was not paying the maintenance. According to complainant in the campus of civil court on 02.04.2013 the accused persons tried to take away her child forcibly.

On behalf of the petitioner, it is submitted that

Patna High Court Cr.Misc. No.24335 of 2015 (2) dt.13-07-2015 2/2 petitioner is ready to keep the complainant with dignity but the same is not acceptable to the complainant. It is further submitted that in the maintenance case the family court has ordered to the petitioner for giving Rs. 5000/- each month to the complainant It has been submitted on behalf of the State that the petitioner is named in the first information report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Smt. Rashmi Prasad, Judicial Magistrate, 1st class, Patna in connection with complaint case No. 1173 (C )/2013, subject to condition as laid down under section 438(2) of the Cr. P.C.
