JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 03-07-2018 Heard learned counsel for the petitioner and State. The petitioner is in custody since 26.1.2018 in connection with Forbesganj P.S. Case No. 43 of 2018 for the offence under Section 392 of the Indian Penal Code. Learned counsel for the petitioner submits that the petitioner was not put up on T.I.P. in the instant case registered against four unknown notwithstanding the fact that the petitioner was in custody since 26.1.2018. Counsel for the petitioner further submits that other co-accused namely Chandra Shekhar Kumar Yadav @ Chandra Shekhar and others, Sunil Kumar Yadav @ Bachha Yadav and Dilkhush Kumar Paswan @ Dilkhush Kumar have been granted bail by Co-ordinate bench of this Court in Cr. Misc. No. 23783 of 2018, Cr. Misc. No. 26048 of 2018 and Cr. Misc. No. 26477 of 2018 vide order

Patna High Court Cr.Misc. No.27870 of 2018(3) dt.03-07-2018 2/2 dated 17.05.2018, 02.05.2018 and 24.05.2018.

Considering the fact that the other co-accused have been granted bail by Co-ordinate bench of this Court, let the petitioner named above, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 43 of 2018.
