2. The petitioners are in custody since 27.01.2017 in connection with Gopalpur P.S. Case No. 107 of 2016 for the offences alleged under Sections 304(B), 120B, 201/34 of the Indian Penal Code.
3. It is submitted that the petitioners are the ladies being the mother and maternal grandmother respectively of the husband of the deceased, who claim clean antecedents and they have been falsely implicated on mere suspicion as the deceased died owing to epileptic attack during pregnancy causing miscarriage. The accusations are general and omnibus in nature. Similarly situated co-accused Motilal Das and Hari Das @ Harihar Das being the respective husbands of the petitioners have been granted bail by this Court in Cr. Misc. No. 12853 of 2017.
4. Be that as it may, let the petitioner above named be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of like amount each to the
Patna High Court Cr.Misc. No.16656 of 2017 (2) dt.06-04-2017 satisfaction of learned Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Gopalpur P.S. Case No. 107 of 2016, on the following conditions:- (i) That one of the bailors of each of the petitioners shall be their close relatives.
(ii) That the petitioners shall not indulge in any similar offence till conclusion of the trial. (iii) That the petitioners will be well represented in court on each and every date during trial and in the event of failure on two consecutive dates without sufficient reason, their bail bonds shall be liable to be cancelled by the learned Court concerned. (iv) The petitioners shall cooperate with the investigation, if not already concluded, and make themselves available as and when so required and in case of failure, the State shall be at liberty to move for cancellation of bail.
