JUSTICE SUDHIR SINGH ORAL ORDER 17-07-2015 The petitioner is apprehending his arrest in connection with Jogbani P.S. Case No. 101 of 2014 for the offences instituted under Sections 147, 149, 341, 323, 324 and 302 of the I.P.C. Heard learned counsels for the petitioner, informant and learned counsel for the State.

The prosecution story, in brief, is that the informant's father, deceased Kishundeo Mandal was sitting on a fallen tree of Khajoor where the accused persons came and picked up a quarrel with respect to some previous dispute. The accused persons assaulted the informant and his father with fists and feet. The accused Bidur Mandal hit on the chest of the father of the informant with a Lota. As a result of which he fell on the ground and died.

Patna High Court Cr.Misc. No.26237 of 2015 (2) dt.17-07-2015 2/2 It has been submitted on behalf of the petitioner that no specific injury has been attributed against the petitioner. It is further submitted that fatal injury has been attributed against Bidur Mandal. It is further submitted that the charge sheet that has been filed in the present case that has been filed under Section 304 of the I.P.C. against the co-accused persons. It is further submitted that other co-accused have been granted anticipatory bail vide Cr. Misc. No. 23347 of 2015.

On behalf of the State and the informant it has been submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Jogbani P.S. Case No. 101 of 2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Araria, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
