The petitioner apprehends her arrest in connection with Charpokhari P.S. Case No.195 of 2014 registered under Sections 419, 420 and 468/34 of the Indian Penal Code. The allegation is that the petitioner being the Mukhiya of the Gram Panchayat-Kaup alongwith others purchased Solar Light at the rate of Rs.27,200/- while the prescribed price of BREDA was Rs.26,915/-.
Learned counsel appearing on behalf of the petitioner submits that the Solar Light was purchased at the rate of Rs.27,200/- after approval of Aam Samiti Gram Panchayat and the
Patna High Court Cr.Misc. No.13760 of 2015 (2) dt.20-05-2015 2/2 similarly situated co-accused, Shanti Devi, has already been granted anticipatory bail by a Coordinate Bench of this Court vide order dated 30.04.2015 passed in Criminal Misc. No.20205 of 2015.
Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within four weeks, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Bhojpur at Arrah, in connection with Charpokhari P.S. Case No.195 of 2014, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
