JUSTICE ARUN KUMAR ORAL ORDER 20-04-2018 Heard learned counsels for the petitioner and the State. The petitioner, already in custody, seeks bail in connection with Chandauti P.S.Case No. 149 of 2017 registered under Section 379 of the Indian penal Code.
Allegation in brief is that petitioner was apprehended with stolen motorcycle of the case.
Submission is that petitioner is in custody since 25.09.2017 and has no criminal antecedent.
Having considered the recovery of stolen motorcycle from the possession of the petitioner, the prayer of bail of the petitioner is rejected. However, trial court is directed to expedite the trial and conclude the same within three months, if the same is not concluded within stipulated period, petitioner may renew his prayer of basil.
