JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 15-05-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in connection with Barh P.S. Case No. 208 of 2012 registered under Sections-364, 302, 201/34 of the Indian Penal Code.

Petitioners are not named in the first information report but in course of investigation, it came to light that the deceased had love affairs with daughter of petitioner No. 1 and being annoyed with the aforesaid love affairs, petitioners took the deceased by a Bolero vehicle. One witness, at paragraph-95 of the case diary, claims to have seen the petitioners taking away the deceased.

Considering the aforesaid facts and circumstances as well

Patna High Court Cr.Misc. No.49999 of 2014 (3) dt.15-05-2015 2/2 as submission of the parties, I am not inclined to extend the privilege of anticipatory bail to the petitioners and accordingly, their prayer for anticipatory bail in connection with Barh P.S. Case No. 208 of 2012 pending in the court of Additional Chief Judicial Magistrate, Barh, Patna stands rejected.
