Petitioner seeks bail in Minapur P.S. Case No.43 of 2020, registered under Sections 25(1-b)a/26 of the Arms Act. The petitioner was apprehended and from his possession one loaded country made pistol was recovered. Learned counsel for the petitioner submits that for recovery of one loaded country made pistol, petitioner is in jail since 12.05.2020. It is also submitted that one criminal case is also pending against the petitioner on the ground that the petitioner jumped out from the Hazat of the police station. It appears that the petitioner was arrested on 04.02.2020, but he managed to flee away from the police station and for that Minapur P.S. Case No.45 of 2020 was registered under Sections 224 and 225 of the Indian Penal Code. Later on,

Patna High Court CR. MISC. No.36455 of 2020(2) dt.30-01-2021 2/2 petitioner was again apprehended on 12.05.2020 and since then he is in custody. Petitioner has already remained in custody for more than seven months for recovery of one loaded country made pistol.

Considering the facts aforesaid, petitioner, namely, Om Prakash Kumar @ Kaliya is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Muzaffarpur in connection with Minapur P.S. Case No.43 of 2020.
