JUSTICE SANJAY PRIYA ORAL ORDER 01-05-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The petitioner seeks bail in Fatehpur Case No.11 of 2016 registered for the offence under Sections 272, 273 of the I.P.C. and 30(a) of Bihar Excise Amendment Act. It is alleged that 52 bottles each containing 300 ml. of Nepali country made liquor has been recovered from the possession of the petitioner.

As per paragraph 3 of the petition the petitioner has no criminal antecedent. He is in custody since 26.11.2016. Learned counsel for the petitioner submits that one of the co-accused Vijay Kumar Viswas has already been granted bail by coordinate Bench of this Court vide order dated

Patna High Court Cr.Misc. No.16708 of 2017 (5) dt.01-05-2017 2/2 01.03.2017 passed in Cr. Misc. No.6022 of 2017. Considering the facts and circumstances of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of J.M. 1st Class, Kishanganj, in Fatehpur P.S.
