The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, the informant states that her husband, the petitioner herein misbehaved with the members of her family. On 18.8.2020, the informant and members of her family were abused and beaten up by the petitioner who was armed with a pistol and a knife. The assault by the petitioner led to a number of injuries on the father-in-law of the informant i.e the father of the petitioner.

It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case as a result of a trivial family dispute between the parties. The

Patna High Court CR. MISC. No.49822 of 2021(3) dt.24-03-2022 2/2 allegations are false and concocted. The petitioner has been sufficiently punished, having remained in custody for more than one year since 17.3.2021.

Having heard learned counsel for the parties and taking into consideration the facts of the case, the relationship between the parties and the petitioner having remained in custody for 1 year, the Court directs the petitioner to be enlarged on bail in connection with Pakridayal P.S. Case no. 140 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M, Motihari, East Champaran.
