2. The petitioner apprehends arrest in connection with Cyber PS. Case No. 21 of 2024 dated 06-07-2024, instituted under Sections 419 and 420 of the Indian Penal Codeand Sections 66 (C), 66(D) of the IT Act..
3. The petitioner is alleged to have committed cyber defamation, blackmail, extortion and misuse of social media to harass and harm the reputation of the informant.
4. Learned counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this case. It is further submitted that the allegation against the petitioner is that he posted and shared dirty photographs along
Patna High Court CR. MISC. No. 39089 of 2025(4) dt.15-10-2025 2/3 with abusive language about the informant and her family on Facebook. It is submitted that in fact, the informant and the petitioner were friends and used to study together. During the course of their friendship, they remained in contact through audio and video calls. During this time, the petitioner gave the informant a loan of about one lakh Rupees. Later, some differences arose between them and the informant got married to someone else. After her marriage, the petitioner asked for the return of his money and in order to usurp the aforesaid amount, the informant falsely implicated the petitioner and filed this case. It is also submitted that not only the petitioner but even his mother has been made accused in the case. Further, during the course of investigation, nothing objectionable was found on the petitioner's Facebook, Instagram or email accounts. There is no evidence to support the allegations made against him. Lastly, it is submitted that the petitioner has no criminal antecedents.
5. Learned APP has opposed the prayer for bail.

Having considered the facts and circumstances of the case and submissions of learned counsel for the parties, in the event of arrest or surrender before the Court below within six weeks from today, the petitioner be released on bail upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two
Patna High Court CR. MISC. No. 39089 of 2025(4) dt.15-10-2025 3/3 sureties of the like amount each to the satisfaction of the learned ACJM Ist Begusarai, in Cyber PS. Case No. 21 of 2024 subject to the conditions laid down in Section 482(2) of the Bharatiya Nagarik Suraksha Sanhita 2023.
7. The application stands allowed.
