JUSTICE SUDHIR SINGH ORAL ORDER 16-07-2015 The petitioner is apprehending his arrest in connection with Complaint Case No. 24988C of 2014 for the offence under Sections 498A/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act.
Heard learned counsel for the petitioner and the State.
The prosecution story, in brief, is that the complainant was married with the petitioner about 12 years ago and thereafter she was demanded Rs. 2,00000,/- cash, Tempo as dowry and non-fulfillment of the said demand she was put on torture and cruelty.
It has been jointly submitted that the husband, the petitioner and complainant are ready to stay together. Hence,
Patna High Court Cr.Misc. No.25981 of 2015 (2) dt.16-07-2015 in the said circumstances, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of ten weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna in connection with Complaint Case No. 24988C of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
It is further directed that the learned court below shall issue a notice upon the complainant and on her appearance the Court below shall ensure that both petitioner and complainant leave from the Court together. (Sudhir Singh, J) P.K./- U T
