The petitioners seek bail in connection with Kachhawa P.S. Case No. 27 of 2016 registered for the offence punishable under Sections 341, 323, 504, 307, 379, 354 and 34 of the Indian Penal Code Learned counsel for the petitioners submits that allegation of assault on informant and his wife is omnibus in nature and all the injuries caused have been found to be simple in nature. He further submits that similarly situated co-accused Soukat Ali Khan, has been allowed bail by a co-ordinate Bench of this Court vide order dated 14.02.2017 passed in Cr. Misc. No. 4269 of 2017. The case of these petitioners stands on similar footing and so they deserve bail.
Patna High Court Cr.Misc. No.11752 of 2017 (2) dt.15-03-2017 2/2 Learned APP, on the other hand, opposed the prayer. Considering the nature of the allegation against these petitioners as also the fact that similarly situated co-accused person enjoying the privilege of bail, their prayer of bail is allowed. The petitioners, above named who are in custody since 26.02.2016 are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Rohtas in connection with Kachhwa P.S.
