In this case, the petitioner is seeking anticipatory bail in connection with Kishanganj P.S. Case No. 681 of 2017 registered for offence punishable under sections 379 and 356 of the Indian Penal Code.

It has been alleged that two unknown persons have looted Rs.2,00,000/- (two lacs) from the victim. During investigation, the name of this petitioner transpired which has been mentioned in paragraphs 24, 25 and 32 of the case diary as recorded by the court below, inasmuch as the petitioner has criminal history of one case.

Looking to the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner and

Patna High Court CR. MISC. No.37714 of 2019(2) dt.21-06-2019 2/2 accordingly his prayer for bail is rejected. However, if the petitioner surrenders and prays for regular bail, the court below without being prejudiced by this order, will take decision in accordance with law, preferably on the same day.
