Learned counsel for the petitioners submits that the petitioner no.8 has been arrested, hence prayed to withdraw the bail application as against the petitioner no.8.
Patna High Court CR. MISC. No.49699 of 2021(2) dt.15-02-2022 2/2 Prayer allowed.
The bail application of the petitioner no.8 is dismissed as withdrawn.
The petitioners seek bail in anticipation of their arrest in connection with Biraul P.S. Case No.125 of 2021 instituted for the offences under Sections 341, 323, 324, 354(A), 307, 379, 148, 149 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that no overt act has been alleged against the petitioners. There are prima facie general and omnibus allegation against all the petitioners and specific allegation are mentioned against three other persons who are not before this Court.
Taking into consideration the aforesaid aspect, I am inclined to grant benefit of anticipatory bail to the petitioners and in the event of arrest, they shall be released on bail subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
