JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 04-01-2023 Heard learned counsel for the petitioner, learned counsel for the State and perused the case diary. The petitioner is in custody in a case registered for the offence punishable under Sections 413 and 414 of the Indian Penal Code.
Allegedly, it is a case of recovery of 67 mobile phones from the possession of the petitioner.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner is in custody since 28.01.2022.
Learned APP appearing for the State has opposed the prayer for regular bail and submitted that aforesaid 67 mobile phones were recovered from the possession of this petitioner. After considering the facts and circumstances of the
Patna High Court CR. MISC. No.40457 of 2022(3) dt.04-01-2023 2/2 case, I am not inclined to grant regular bail to the petitioner. Prayer for regular bail of the petitioner is hereby rejected.
However, the court below is directed to expedited the trial expeditiously.
