JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 31-08-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 420, 409, 120(B), 467, 468 and 471/34 of the Indian Penal Code.

Petitioner was Block Development Officer of Ladniya, at the relevant time and the present case was lodged on the basis of his written report. The petitioner levelled allegation against the Panchayat Secretary and Mukhiya, in respect of several irregularities and embezzlement committed by Panchayat Secretary and Mukhiya but in course of investigation, it came to light that the certificates issued in the name of dead persons, were signed and stamped by the petitioner and on that basis, the account in bank was opened.

Patna High Court Cr.Misc. No.36471 of 2016 (2) dt.31-08-2016 2/2 Submission on behalf of the petitioner is that Panchayat Secretary and Mukhiya have already been granted privilege of bail and as a matter of fact, on the basis of identification made by the Panchayat Secretary and concerned Mukhiya, the petitioner signed and stamped the concerned documents.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate 1st Class, Madhubani, in connection with Ladaniya P.S. Case No. 32 of 2010.
