Petitioner seeks bail in Jaynagar P.S. Case No.217 of 2019 instituted for the offence under Section(s) 272, 273, 414/34 Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that two persons were apprehended by the police on motorcycle during patrolling. One person managed to run away and this petitioner was arrested. It is further alleged that 72 litres Nepali liquor has been recovered from the motorcycle.

Counsel for the petitioner submits that petitioner was merely pillion rider and driver of the motorcycle managed to run

Petitioner is in custody since 29.04.2019 having clean antecedents.

In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the 2nd Additional Sessions Judge cum Special Judge, Excise Act, Madhubani, in connection with Jaynagar P.S. Case No.217 of 2019, subject to the condition that both the bailors shall be close relative of the petitioner.
