10-08-2016 Heard Sri Jitendra Narain Sinha, learned counsel for the petitioner and Sri Damodar Prasad Tiwari, learned Addl. Public Prosecutor.
This is the 2nd attempt for grant of bail on behalf of petitioner. Earlier, by order dated 26-11-2015, the prayer for bail of the petitioner was rejected, vide Cr. Misc. No. 50811 of 2015. This time prayer has been renewed on the ground that out of eight prosecution witnesses, six have turned hostile. Learned counsel for the petitioner tried to persuade the Court to examine the evidence, which has been brought on record. The Court is of the opinion that examination of evidence is now required to be done by the trial court, not by this Court. Since trial is going on, there is no reason to extend the
Patna High Court Cr.Misc. No.33220 of 2016 (2) dt.10-08-2016 2/2 privilege of bail.
The petition stands dismissed.
