JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 19-04-2017 Heard learned counsel for the petitioner and the learned counsel representing the State.
The petitioner wants to renew the prayer of bail which was earlier rejected by order dated 06.05.2016 passed in Cri. Misc. No. 12933 of 2016, on the ground that the petitioner is suffering in custody since 15.01.2016, there is no direct or circumstantial evidence against him, other co-accused except Deepak Paswan have already been allowed bail, in near future the trial is not likely to be concluded and, as such, the petitioner also deserves sympathetic consideration.
Learned A.P.P. opposes the prayer of bail by submitting that Kamta Mushar being an eye-witness has stated the name of the petitioner also that he and others took away the
Patna High Court Cr.Misc. No.5659 of 2017 (3) dt.19-04-2017 2/2 deceased at the point of gun.
In the facts and circumstances stated above, finding no good ground for reconsideration of prayer of the bail, again prayer of the bail of the petitioner stands rejected. However, considering the detention of the petitioner, let the trial be expedited and concluded as early as possible preferable within sixth months from date of receipt/production of a copy of this order.
