The petitioner seeks regular bail in connection with Barachatti P.S. Case No.216 of 2018 for the offence punishable under Section 30(A) of the Bihar Amended Excise Act, 2016. Allegation of the prosecution is that there is recovery of 400 liters of Jharkhand liquor from an Ikon Car.
The learned counsel for the petitioner submits that neither the petitioner is owner of the said vehicle nor the said illicit liquor has been recovered from the conscious possession of the petitioner and the petitioner has been falsely implicated in the present case. It is stated that the petitioner is having a clean antecedent and is languishing in custody since 23.03.2018.
Having regard to the facts and circumstances of the case, the
Patna High Court Cr.Misc. No.28770 of 2018 (3) dt.21-05-2018 2/2 petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (rupees Ten thousand) with two sureties of the like amount each to the satisfaction of learned Court of Special Judge, Excise, Gaya in connection with Barachatti P.S. Case No.216 of 2018.
