Petitioner is languishing in custody since 12.05.2016 in a case registered for the offences punishable under Sections 498A, 328, 302, 201/34 of the Indian Penal Code.
The prosecution case is that on 11.05.2016 at 3.00 P.M. the informant received information that his sister consumes pesticide Selphas and died. The husband of the victim along with villagers took away the dead body for cremation. It is alleged against the petitioner that he facilitated in disposal of the dead body.
Learned counsel for the petitioner submits that petitioner is not the family member of the victim. Even assuming the accusation only offence under Section 201 of
Patna High Court Cr.Misc. No.32137 of 2016 (2) dt.01-08-2016 the Indian Penal Code is made out against the petitioner which is bailable.
Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Jamui in connection with Khaira P.S. Case No. 106 of 2016.
