JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 07-05-2015 This is an application seeking anticipatory bail in a case registered for the offences punishable under sections 341, 323, 324, 327, 307, 379, 504 and 506/ 34 of the Indian Penal Code.

Learned counsel for the petitioners has submitted that within a period of one and half months, one Radheshyam Singh and his family members have got instituted four criminal cases including the present one. He contends that prior to the institution of the present Bajpatti PS case No. 30/2014, petitioner No.1 had instituted a case for the offences punishable under sections 323, 324, 341, 307, 379, 504 and 506/34 of the IPC implicating the said Radheshyam Singh and his family members. No.50134 of 2014 (3) dt.07-05-2015 2/2 contended that co-accused Rohan Kumar Singh has been granted regular bail by an order dated 17.10.2014 and no tangible purpose will be served if the petitioners are taken into custody inasmuch as they are ready to co-operate with the police in course of investigation or thereafter in course of trial. In view of submissions, as above, the petitioners, above named, in the event of their arrest/ surrender within a period of six weeks from today shall be released on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Bajpatti PS case No. 30/2014, subject to condition as laid down u/s 438(2) of the Code of Criminal Procedure.

This is subject to condition that the petitioners shall co-operate with the police in course of investigation and they will present themselves before the police as and when required and if they failed to do so, the prosecution shall be at liberty to approach this court for cancellation of their bail bonds.
