JUSTICE SUDHIR SINGH ORAL ORDER 23-07-2015 The petitioner is apprehending his arrest in connection with Kundwa Chainpur P.S. Case No. 04/2015 for the offences instituted under Sections 498(A), 379, 506/34 of the IPC and 3⁄4 of the D.P. Act.
Heard learned counsel for the petitioner and learned counsel for the State.
The accusations are of demand of dowry and on nonfulfilment of the same the informant was tortured by the accused persons.
It has been submitted on behalf of the petitioner that the petitioner is ready to keep the informant but the same is not
Patna High Court Cr.Misc. No.28805 of 2015 (2) dt.23-07-2015 2/2 acceptable to her. It is further submitted that the petitioner is ready to deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the informant. On behalf of the State it has been submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that the petitioner shall deposit amount of Rs. 1500/- per month in the court below which shall be released in favour of the informant and on doing so, let the petitioner above named, be released on bail in the event of his arrest or surrender before the learned court below within a period of six weeks from today in connection with Kundwa Chainpur P.S. Case No. 04 of 2015 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned SDJM, Sikrahana at Motihari, East Champaran, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
