The petitioner apprehends his arrest in connection with Kishanganj P.S. Case No. 169 of 2018 registered under Section 379 of the Indian Penal Code.

The accusation is that regarding theft of motorcycle of informant in the night of 02.03.2018, Kishanganj P.S. Case No. 169 of 2018 was instituted against unknown. Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. but in course of investigation, the name of the petitioner has surfaced in the confessional statement of co-accused, Nitish Kumar. Further submission is that, in fact, petitioner was made accused in

Patna High Court CR. MISC. No.39297 of 2019(2) dt.27-06-2019 2/2 Kishanganj P.S. Case No. 98 of 2018 due to that reason he has falsely been implicated in the present case and in Kishanganj P.S. Case No. 98 of 2018, petitioner is on bail. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, Kishanganj, in connection with Kishanganj P.S. Case No. 169 of 2018, subject to the condition as laid down under Section 438(2) of the Cr.P.C.
