JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2016 Heard learned counsel for the petitioner, the State and the informant.

The petitioner seeks bail in a case instituted for the offences under Sections 406, 420, 467, 468, 471/34 and 120B) of the I.P.C.

Allegation is that on persuasion of one Suman Kumar, the informant gave Rs.15 lacs to Suman Kumar for investment in Sahara India, a financial company, but subsequently it was found that Suman Kumar did not make any investment in Sahara India. Hence suspicion was raised against the petitioner also being the brother of Suman Kumar.

It has been submitted on behalf of the petitioner that

Patna High Court Cr.Misc. No.35699 of 2016 (3) dt.24-10-2016 2/2 the petitioner is in custody since 21.5.2016 and the charge sheet has been submitted in the present case. There is no allegation of tampering of witnesses alleged against the petitioner. The main allegation has been made against the co-accused, namely, Suman Kumar. No money is said to have been deposited with the petitioner. The other co-accused has been granted bail vide Annexure-3 to the present application.

On behalf of the State and the learned counsel for the informant, it is submitted that the petitioner is named in the F.I.R. Considering the aforesaid facts and circumstances, it is directed that the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of learned Assistant Chief Judicial Magistrate-cum- Sub Judge 14, Vaishali at Hajipur in connection with Hajipur Town P.S. case No.727 of 2011.
