Petitioner is accused in connection with Gaya Mufassil P.S. Case No. 58 of 2017 registered under Section 30(a) of the Bihar Prohibition and Excise Act, 2016 and section 25(1b)a, 26 and 35 of the Arms Act. Learned counsel for the petitioner submits that nothing has been recovered from the conscious possession of the petitioner except cash Rs. 5800/-. The alleged recovery of rifle and wine is from the possession of co-accused. It is submitted that petitioner is in custody since 22.02.2017.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on

Patna High Court Cr.Misc. No.17470 of 2017 (2) dt.02-05-2017 2/2 furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Gaya Mufassil P.S. Case No. 58 of 2017.
