JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-07-2015 Heard learned counsels for the petitioner and the State. The petitioner being Panchayat Mukhia is apprehending arrest in a case registered for the offences punishable under Sections 409,420 and 468/34 of the Indian Penal Code. The prosecution case is that during 20010-11 and 201314 the funds of 12th and 13th financial year and BRGF were diverted for purchase of solar lights.

It is submitted by the learned counsel for the petitioner that the accusation is not that the solar lights were not purchased but it was only alleged irregularity by diversion of funds. More over, co accused Bimla Devi and Kedar Nath Mishra have been granted bail vide Cr. Misc. no. 50179 of 2014 and 12752 of 2015. Considering the nature of accusation, co accused being granted anticipatory bail and the petitioner being lady, let
