JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Begusarai Complaint Case No. 88C of 2019 in which cognizance has been taken under Section 498A of the Indian Penal Code.

Allegation against the petitioner is that he subjected her wife to cruelty and assault with respect to demand of dowry and further allegation is that he solemnized second marriage. Submission of learned counsel for the petitioner is that he remarried with consent of opposite party No.2 and he is not in a position to pay Rs.6 lac to opposite party No.2 as she demanded the same for one time settlement.

Heard learned APP and learned counsel for opposite

Patna High Court CR. MISC. No.39982 of 2019(6) dt.23-10-2019 2/2 party No.2, who has opposed the prayer for anticipatory bail stating that she is not ready to reside with the petitioner as she was subjected to severe cruelty and petitioner solemnized marriage with another lady, rather she wants for one time settlement and her demand is Rs.6 lac.

In view of above facts and circumstances, let petitioner appear and pray for regular bail, which shall be considered on its own merit, without being prejudiced by this order.

This application is, accordingly, dismissed.
