The Petitioner seeks quashing of the order of cognizance dated 04.04.2009 passed by the Judicial Magistrate, 1st class, Patna, in Complaint Case No.324-C of 2008.
The case of the Complainant is that the parties transacted sale of certain piece of land upon which an agreement was entered into between them. However, Sale Deed was not executed and the money was sought to be returned to the Complainant by way of cheques. When the Complainant presented the cheques, the same were

Having considered the fact that the Petitioner seeks quashing on disputed question of facts which cannot be gone into at the stage of 482 Cr. P. C., I am not inclined to interfere in the matter. The application is dismissed.
