JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 26-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Section 47(A) of Excise Act and Section 51 of Bihar Excise (Amendment) Act, 2016. Near about 34 litres Indian made foreign liquor is said to have been recovered from joint possession of the petitioner and co-accused, Manoj Mahto. Co-accused, Manoj Mahto has already been granted privilege of bail. Petitioner does not have any criminal antecedent and is languishing in jail custody since 23.04.2016.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on

Patna High Court Cr.Misc. No.39160 of 2016 (2) dt.26-09-2016 2/2 bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 255 of 2016.
