The petitioners seek bail in anticipation of their arrest in connection with Muffasil P.S. Case No. 130 of 2017, dated 09.04.2017, instituted for the offences under Sections 323, 324, 341, 504, 307, 379 and 34 of the

Patna High Court CR. MISC. No.36894 of 2020(2) dt.08-04-2021 2/3 Indian Penal Code.

The learned counsel for the petitioners has submitted that the victims have received injuries which are said to have been caused by hard and blunt substance and not by any sharp cutting weapon. He has further submitted that all the injuries over the victims have been opined to be simple in nature except one which is on the person of one Vinod Kumar Yadav about which opinion has been reserved. However, from a looking at such injury, it appears that it is only in the nature of tender swelling in the right hand. It has been submitted that some of the other accused persons of this case have been granted anticipatory bail by the Court below. Apart from this, it has been submitted that there is a counter version as well vide Muffasil P.S. Case No. 131 of 2017, lodged by the brother of a co-accused of this case.

The petitioners do not have criminal antecedents. Regard being had to the facts afore-stated, the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of

No.36894 of 2020(2) dt.08-04-2021 3/3 eight weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran, Chapra in connection with Muffasil P.S. Case No. 130 of 2017, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

The application stands allowed.
