JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 30-08-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered under Sections-414/429 of the Indian Penal Code and under Sections11(1)(Gh) of the Animal Cruelty Act, 1960. 79 oxen, loaded on different trucks, were seized and petitioners along with some accused were arrested on the spot. The informant claims that the aforesaid oxen were stolen property and petitioners and their associates were found in illegal trade. Submission on behalf of petitioners is that the aforesaid oxen had been purchased by the petitioners from Government fair and receipt of the purchase had been produced before the Sessions Court at the time of consideration of regular

Patna High Court Cr.Misc. No.36364 of 2016 (2) dt.30-08-2016 2/2 bail application of the petitioners but the learned Sessions Judge without considering the aforesaid documents, rejected the prayer for bail of the petitioners.

Considering the above-said facts and circumstances of the case as well as submission of the parties, let the petitioners named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each in connection with Siswan P.S. Case No. 66 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Siwan. (Hemant Kumar Srivastava, J) A.K.V./- U T
