2. Petitioners seek pre-arrest bail in connection with Bihpur P.S.Case No.193 of 2024, registered for the offences punishable under Sections 341, 323, 324, 307, 506 and 34 of the Indian Penal Code.
3. As per the allegation made in the FIR, the petitioners were forcibly creating boundary wall over the land of the informant, which was objected by his son namely, Vikram Sharma and one Mona Sharma. Petitioner no.1 (Manoranjan Sharma) and other co-accused persons assaulted the son of the
Patna High Court CR. MISC. No.41353 of 2025(3) dt.08-10-2025 2/3 informant and other persons, who came to save him.
4. Learned counsel appearing on behalf of the petitioners submitted that the petitioners are innocent and they have not committed such offence. Learned counsel further submitted that there is case and counter case between the parties.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail to the petitioners.

Having considered the rival submissions made on behalf of the parties, as well as, considering the fact that there is general and omnibus allegation against the petitioners no.2 (Janki Kumari @ Janaki Devi) and 3 (Mira Devi), they are directed to be released on pre-arrest bail, in the event of their arrest or surrender before the learned district court within a period of four weeks from today, on furnishing bail bond of Rs.10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned J.M. Ist class, Naugachia/concerned court, in connection with Bihpur P.S.Case No.193 of 2024, subject to conditions as laid down under Section 482(2) of BNSS of 2023
7. So far as petitioner no.1 (Manoranjan Kumar @ Manoranjan Sharma) is concerned, there is specific allegation of

No.41353 of 2025(3) dt.08-10-2025 3/3 assault against him and the injury report, which has been brought on record along with the case diary, reveals that the injury is grievous in nature and it is attributable to the petitioner no.1, who has assaulted the son of the informant, I am not inclined to enlarge the petitioner no.1 on pre-arrest bail.
9. However, the petitioner no.1, if so advised, may surrender before the learned district court and seek regular bail and the learned District Court may consider the bail application of the petitioner on the same day and pass a reasoned order in accordance with law.
10. With the above observation/direction, the present bail application stands disposed of.
