JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 448, 323, 324, 307/34 of the Indian Penal Code.
It is a case of misuse of privilege of bail for a long period but one co-accused, namely, Daso Manjhi, having similar allegation, has already been granted privilege of bail.
Accordingly, the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Sessions Judge-Vth, Nawada, in connection with S.Tr. No. 184 of 2000/362 of 2016 arises out of Akbarpur P.S. Case No. 82 of 1999 (G.R. No. 1119 of 1999).
