The petitioner is in custody in connection with Excise Case No.1067 of 2020 arising out of Sandesh P.S. Case No. 238 of 2020, for the offence under Section 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. The name of the petitioner was disclosed by co-accused Kanhaiya Choudhary who was apprehended along with 55 litres of country made liquor. Petitioner is in custody since 13.08.2020.

Considering the fact that the petitioner has no criminal antecedent and he is in custody since 13.08.2020, the Court is

Patna High Court CR. MISC. No.36776 of 2020(2) dt.01-02-2021 2/2 inclined to grant bail to the petitioner subject to the condition that the petitioner has to deposit Rs.25,000/- in cash. On depositing the amount of Rs.25,000/-, petitioner, above-named, shall be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of 4th Additional Sessions Judgecum-Special Judge, Excise, Bhojpur at Ara in connection with Excise Case No. 1067 of 2020 arising out of Sandesh P.S. Case No. 238 of 2020.
