JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 27-01-2022 Heard learned counsel for the petitioner and learned A.P.P for the State through video conferencing. The petitioner seeks bail in Bakhari P.S. Case No. 366 of 2019, registered for the offence punishable under Sections 448, 354B, 376(A) of the Indian Penal Code and section 8 of the POCSO Act.
Earlier the bail application of petitioner was rejected vide order dated 06.02.2020. Vide order dated 13.12.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'D'), which reveals that charge has already been framed. Four witnesses out of eleven witnesses have already been examined including informant and victim. Considering the nature of accusation and stage of
Patna High Court CR. MISC. No.239 of 2021(8) dt.27-01-2022 2/2 trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
