Petitioner, namely, Richu Devi aged about 20 years is in custody since 18.09.2015 in connection with Nagarnausa P.S. Case No.148 of 2015 under Sections 353, 332, 333, 307, 115/34 I.P.C. and subsequently added Section 302 I.P.C. as the I.O. died when he was taken to hospital for treatment.
According to the prosecution case, the house of the husband of the petitioner was raided by police on getting information that the husband of the petitioner has shot dead his uncle. When the police raided the house, this petitioner made hulla as to why they are entering the house forcibly and instigated her
Patna High Court Cr.Misc. No.34936 of 2016 (2) dt.20-08-2016 husband to fire and, therefore, her husband fired at the police. The learned counsel for the petitioner submitted that the allegation of firing is against the petitioner and the petitioner was arrested along with her three months child on 18.09.2015 and since she is in custody. The husband of the petitioner has also been arrested and is in custody since 30.09.2015.
Considering the nature of allegation against this petitioner and considering the fact that the petitioner is in custody along with her minor child aged about one year now and three months on the date of arrest, I direct that the petitioner above named be released on bail on furnishing bail bond of Rs.10,000.00 (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned 1st Additional Sessions Judge, Bihar Sharif, Nalanda in connection with Nagarnausa P.S. Case No.148 of 2015.
