2. The petitioner seeks bail in connection with Vijayipur P.S. Case No. 84 of 2024 registered for the offence under Sections 341, 323, 354, 504, 34 of the Indian Penal Code and Section 12 of the POCSO Act.

3. The accused/petitioner is named in the F.I.R. and is in custody since 10.02.2025.

4. As per FIR, the petitioner alongwith other co-accused persons gagged the mouth of the grand daughter of the informant, forcibly boarded her on a bike and also made an attempt to outrage her modesty.

5. Learned counsel appearing on behalf of the petitioner

Patna High Court CR. MISC. No.43468 of 2025(5) dt.22-12-2025 2/3 submitted that out of local disputes and differences, the petitioner implicated with present occurrence. It is pointed out that the same allegation is also available against co-accused Suraj Yadav, who has already granted bail by one of the learned co-ordinate Bench of this Court through Cr. Misc. No. 32611 of 2025 dated 22.05.2025. While concluding argument, it is submitted that investigation of this case is already completed, for which chargesheet has been submitted, as such, there is no chance of tampering with the evidence. Petitioner claimed clean antecedent.

6. Learned APP duly assisted by learned counsel appearing for the informant, while opposing the prayer of bail submitted that this petitioner actively found involved in the occurrence.

Considering the aforesaid factual submissions and by taking note of fact as similarly situated co-accused person has already granted bail by one of the learned co-ordinate Bench of this Court, coupled with the fact that investigation of this case is already completed, where petitioner being man of clean antecedent, remains in custody since 10.02.2025, accordingly, petitioner above named, is directed to be released on bail in connection with Vijayipur P.S. Case No. 84 of 2024, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties

No.43468 of 2025(5) dt.22-12-2025 3/3 of the like amount each to the satisfaction of learned District & Additional Sessions Judge-VI-cum-Special Judge, POCSO, Gopalganj/concerned Court, subject to the conditions as mentioned under Section 437(3) of the Cr.P.C./Section 480(3) of BNSS.
